Difficult time ahead for the Yellows(succession) and their PR machine has been running full steam since Thaksin took office and shook up the elite in Bangkok.<br />
 The majority of Thais are coalescing against this elite clan so the Yellow team supported another coup.<br />
 Thailands reputation and economy has gone down the toilet ever since that ill advised coup.<br />

"Ever wonder why Khunying Pajamarn has not been found to be inviolation of anything in the Ratchadapisek land deal while Thaksin is found guilty of abusing his power over the same land deal?<br />

I thought the ruling was “interesting” so I went on a little hunt to see what the boo-ha-ha is all about.<br />
<br />
Well, judge for yourself….<br />

The FIDF is an entity set up to solve financial crises in the country many years before Thaksin arrived on the political scene. This office first put this land on public auction in July 2003. There were three development companies that were interested. However, the minimum bid was too high (B870 Mil) and FIDF cancelled the auction.<br />
<br />
In November 2003, FIDF again announced sale of this land to the public via its website. Khunying Pajamarn was interested in the land for residential purposes and appointed her attorney submit a bid.<br />
<br />
The FIDF appointed two committees to supervise the bidding process, the bid acceptance committee and the price opening committee. There were 4 potential bidders. But before each potential bidder can submit a bid, their qualification must be approved by these committees. One of the potential bidders was disqualified because their attorney who submitted the bid was not properly authorized. Khunying Pajamarn (offered B772 Mil) and two others are found to be qualified. The other two were publicly listed real estate developers, Noble Development Public Co. LTD. (offered B750 Mil), and House Public Co. LTD. (offered B730 Mil). <br />
<br />
In December 2003, after the opening of the bidding price, the committee held a meeting to approve the sale to the highest bidder and the Land Sale and Purchased Agreement was signed with Khunyin Pajamarn. <br />
<br />
Also in December 2003, Thaksin, as a husband, signed the consent form required to effect the registration of the land transfer. As part of the formality of any registration of real estate requiring spousal consent, he used his official identity card. It shows his official title as Prime Minister. <br />
<br />
And this is important… Prior to putting down his signature, it was confirmed that the office of the Prime Minister is neither the office in charge of, nor has the authority to direct or supervise the FIDF. This is supported by the Supreme Court decision No. 4655/2533 which ruled that the FIDF is a separate and distinct juristic body independent from the Ministry of Finance and the Bank of Thailand. It has its own rights and duty in accordance with laws and regulations within the boundary of its objectives. <br />
<br />
Well, if law is law, it would appear that the sale was legally done by public auction, which means anyone can participate. I would think this includes a Prime Minister’s wife as well. It would also appear that the whole process was done properly and transparently. In the bidding clauses, the FIDF even reserved the right to not sell to any one, including the highest bidder. The transaction is not an abuse of power by the office of the Prime Minister, nor is it a conflict of interest as supported by the ruling of the Supreme Court's decision. <br />
<br />
This case amplifies what I and many Thais already know. Unfortunately, we are doomed to live our lives under sensationalized rumors and highly charged fabrications where our politic is concern. It’s unlikely there are efforts on any one’s part to really inform the public the truth behind rumor based and politically motivated charges. I would think if there were any intention to corrupt or abuse power, it would have been much simpler and nothing to have someone else purchase the land. The Shinnawatra would not have personally involved themselves. Fact is, Khunying Pajamarn was informed she is qualified to participate and buy the land and Thaksin's office confirmed FIDF is a separate entity and not a part of the central administration. The sale and purchase was done in good faith with consideration paid and in accordance to the law......That is if Law is Law....<br />
<br />
Here’s section 100 of the Organic Act on Counter Corruption Thaksin is found to be in violation of. <br />
<br />
Section 100 Any State official shall not carry out the following acts:<br />
(1) being a party to or having interest in a contract made with a Government agency where such State official performs duties in the capacity as State official who has the power to conduct supervision, control, inspection or legal proceedings;<br />
(2) being a partner or shareholder in a partnership or company which is a party to a contract made with a Government agency where such State official performs duties in the capacity as a State official who has the power to conduct supervision, control, inspection or legal proceedings;<br />
(3) being a concessionaire or continuing to hold a concession from the State, State agency, State enterprise or local administration or being a party to contract of a directly or indirectly monopolistic nature made with the State, a Government agency, State agency, State enterprise or local administration, or being a partner or shareholder in a partnership or company which is a concessionaire or a contractual party in such manner;<br />
(4) being interested in the capacity as a director, counsel, representative, official or employee in a private business which is under supervision, control or audit of the State agency to which such State official is attached or where such State official performs duties in the capacity as State official, provided that the nature of the interest of the private business may be contrary to or inconsistent with public interest or the interest of the Government service or may affect the autonomy in the performance of duties of such State official.<br />
The positions of State officials prohibited from carrying out the activities under paragraph one shall be prescribed and published in the Government Gazette by then N.C.C Commission.<br />
The provisions of paragraph one shall apply to spouses of the State officials under paragraph two. For this purpose, the activities carried out by the spouse shall be deemed as the activities carried out by the State official.<br />

Since weeks I hear talks of election for the vilalge heads (pooyabaan).<br />
Wife went to spent many evenings socialising/supporting what she hopes will become the next pooyabaan. Brings some color in the boring village life.<br />
<br />
We live 1 km outside the village and last night the neighbouring dogs were barking at 1.30.<br />
I was dreaming arriving at some airport where the idiot customs where checking every passenger, even this one who did not carry any luggage.<br />
<br />
Anyway got up to look up the street to see some people with flash lights leaving neigbouring houses, thus the dogs having good reasons to warn the sleeping folks.<br />

Wife said probably people handing over money to buy votes. What!!! at 01.30????<br />
Reply: it better be done in the dark.<br />

On Tuesday, we went apartment hunting, found something the same day,and moved in on Thursday.  We didn't have any furniture to speak of because a Uhaul truck would've been around $800 (plus gas) which was more than what we paid for our stuff, so instead we just loaded up two cars with whatever we could fit.  Dee has some friends here, and luckily one of them was looking to get ride of two beds and a living room set.  SOLD! (for $300...really nice couches too)  Then on Friday we went to a goodwill superstore which had almost everything else we needed for less than $200.  So by Saturday we were almost fully furnished...with the execption of a dining room table.<br />

The apartment is located close enough to the strip that we can get there easily, but far enough away that the traffic and crime won't affect us.  It is a large complex wigth over 500 units, and plenty of new freinds for Katie to play with...and 3 pools, 2 basketball courts and a playground.  We got pretty lucky, I think.<br />
 <br />
Also on Friday I took my test to work for the State Department in overseas consulates.  I had gotten a study guide form them earlier, which was really difficult, but thankfully, the actual test was much easier.  I won't know the results for another few weeks, (and the end of the process won't be until after the first of the year) but I think I did pretty well.<br />

Next is finding a short term job.<br />

I know they can grow a little extra food , but what if they do not have land, <br />

My regular girl who I have known for 5 years has a factory job but is taking care of her parents and they are taking care of her 3 year old when she works, <br />

I would like to help her figure out a small extra income , even  2000-3000b a month would really help, <br />
<br />
YES I could give her the money , and I have helped her out in the past, but I am not going to be in the picture forever and she is 30 years younger than me.<br />
<br />
So she needs to make some Baht for 20-30 years, <br />
<br />
I know here in California there are classes for about anything , but I douht there is in Issan.<br />
<br />

I have talked to her about lowering her expenses, even just getting a cheaper room, but with a "family" of 4 she is really stuggling.<br />

Are there  decent libraries in the small towns with books on sewing etc in Thai ?<br />

I have what is equivilant to a lifetime membership. I signed up for Pilates about two years ago but did not keep a regular schedule.  A few months ago I decided to get back into the program and got a hard sell for a new contract and found myself with about 90 hours of classes that I had paid for.  I did not realize how many I had when I signed up for the final 50.  These cost about 800 baht per hour.  <br />
<br />
Now I have gotten the number down to less than 70 but my current trainer has been really on my case to sign up for a new contract.  ('My numbers are bad; can you help me?')  And this goes on after almost every session.  I like working with her but keep telling her I am not going to sign up for more until I get done with what I have and that will not likely be until the end of the year.<br />
<br />
  1.  The trainer that signed me up for the first 25 quit.  <br />
<br />
  2.  When I got down to about 10 the second trainer sold me a 35 hour contract.  Then she quit.<br />
<br />
  3.  The trainer that sold me (a sucker for a pretty face and good body) the 50 session contract immediately got transferred to a different CA WOW.  <br />
<br />
  Am I a problem?  I don't think so.<br />
<br />
  So now, the latest trainer seems to expect me to keep herself and the CA WOW in business by buying another contract.  <br />
<br />
  I was recently away for a week or so and before I left she told me that she had two customers that were going to pay for contracts and one of them wanted my timeslot. She said that she would not have time to fit me in unless I signed a new contract. She also intimated that she would give me better training if I were to buy a contract. Her final argument was 'I guess that you do not want to work with me.'. Not very professional.  She also said that she needed the bonus from the contract because CA WOW had cut their income for the hour down to about 50 baht.<br />
<br />
  This trainer and I work very well together, I enjoy Pilates and it is good for me.  However it is not OK to have a good session and then end up feeling bad about the hard sell.<br />
<br />
  These trainers are under a lot of pressure to sell contracts. I liked it better when they were trainers and not sales people. Earlier this year ThaiVisa had a thread on the CA WOW regarding the possibility of them going broke and it would not surprise me if it were to happen.  Maybe this thread is another nail in the coffin.<br />

Occasional visit at the hospital for the old folks , no other major expenses except money for school and related expenses . And the regular fiesta when BuBi is there for inspection .<br />
